PROPOSED THE LAW ON CITIES PASSING

City and city municipalities in Nis have to go together with the stream of time and maximally and efficiently fulfill all the needs and citizens expectations. That is why the initiative is rounded at the meeting of the presidents of the assemblies of City Municipalities of the City of Nis with Phd Mile Ilic for bringing the Law on cities with which the transfer of the part of Republic authorities to the cities and cities and city municipalities and local community office buildings will take place. According to Ilic words, it is already defined proposition and explanation of this initiative that is directed to the Ministry for local self government. This law will be in the spirit of the highest democratic values and is necessary as to systematically solve the transfer of the part of authorities and work that are closer to citizens themselves i.e. to city municipalities and local communities.

The presidents of the assemblies of five Nis City Municipalities –Mediana, Crveni Krst, Pantelej, Palilula and Niska Banja) once more supported the initiative and expressed the need and readiness that this sort of meetings of the Assembly presidents are to be organized regularly for the fact that there is a great number of themes and problems that could be solved in agreements and without previous unnecessary statue and law changes. The presidents of City municipalities’ assemblies suggested that it should be considered, on the first next meeting, the issue of the work of the Commission for the changes of the street names that will be, according to their opinion, have to consult the representatives of city municipalities and local community offices and in that way the people who live actually in those streets.

In the annex and integral text of the letter that is directed to Ministry of regional development and local self government, to the Minister Kalanovic:

In accordance with the conclusions reached at the meeting held on January 23 2013 in the City Assembly of the City of Nis with the representatives of city municipalities, the president of the Assembly PhD Mile Ilic, directed to Ministry for regional development and local self government, initiative for elaboration and passing the Law on cities.

Respected Minister Kalanovic,

In Serbia, four laws govern the sphere of territorial organization and local self government: Law on territorial organization, Law on local self government, Law on local elections and Law on the Capital City. All those laws, in one whole kind of way, arrange the separate segments of the system of local self government in Serbia. As it is generally known, these laws according to authorities make equal all the cities and municipalities as units of local self government and apart from formal difference in the title, there are no other differences. In the meantime one number of local communities got the status of the City with which the need for other defining of their position came as issue in the system of local self government of Serbia. In the same time, within certain cities city municipalities were constituted with also non defined status. There are known tendencies in EU countries and wider also, for leaving one monotonous character of local self government and establishing of one new many type of local self government form. In our circumstances it will represent the difference between cities and municipalities before all in their authorizations but also in defining of the positions of city municipalities that are active within the City. Since in practice it has been shown that it is not sufficient only law regulation that the relation between cities and city municipalities are arranged with city statutes and from all because of all of these, but also other reasons, we think that it is necessary that the wholeness of the system of local self government in our Republic means the passing of one more law that is the Law on cities. It will arrange the whole problematic issues of the position of the cities as specific forms of local self government in our conditions, and it will also complete law regulation in the system of local self government. That is why, together with the presidents of City Municipal Assemblies of Nis, I am free to suggest the passing the of the Law on cities and I am expressing the readiness that professional human resources in Nis will participate in further discussions on the matter.
